A systematic examination and inquiry of a criminal case is conducted by CVB Investigative Services. In order to achieve a impartial investigation; I review the law enforcement investigation, interview the defendant, locate and interview witnesses, examine the crime scene, conduct background investigations, write reports, testify, and assist defense counsel with trial preparation. The result of an effective and successful investigation is not only limited to use in trial. Evidence uncovered may also result in a lower bond, reduced charges, or the dismissal of charges.
In many cases, I will pursue reasonable doubt by scrutinizing specific aspects of the prosecution's case. Establishing that the prosecution's case is weak or deficient in a key area can be of great importance. You may also call upon me to conduct a comprehensive investigation, support a defendant's alibi, develop alternative suspects, or pursue other potential defense theories. Without question, my role as a member of the defense is as difficult as it is crucial. Therefore, it is important for me as the criminal defense investigator to understand that my focus is to uncover reasonable doubt - not create it.
The criminal defense investigation can be accomplished by following specific investigative components defining the course of the investigation, pursuant to the request of defense counsel.
The following has provided me with the fundamental knowledge and direction necessary to conduct a criminal defense investigation. Following this investigative outline and procedures, I will follow proven methods developed by experienced criminal defense investigators.
Proper training is essential to the success of every investigator. Therefore, I have been willing to dedicate the time and effort required to achieve the knowledge and skills necessary to succeed. I am a member of CCDB (Colorado Criminal Defense Bar). I have served as the vice-president of training for the PPIAC ( Professional Private Investigators Association of Colorado). I am also certified by The CDITC (Criminal Defense Investigation Training Council) in uncovering reasonable doubt by the use of the Component Method. National Director Brandon A. Perron has been an excellent instructor and a inspiration to me.
It is very important for a criminal defense investigator to maintain the highest degree of ethical conduct at all times. I follow these standards while performing in the official capacity of a criminal defense investigator:
1. I conduct all investigative tasks in a professional, ethical, and moral manner.
2. I conduct investigations within the limits of the law.
3. I remain impartial and objective at all times.
4. I protect and do not discuss confidential information with anyone other than designated individuals.
As a successful criminal defense investigator I also possess and have developed specific skills. These skills will enable me to achieve the highest standard of professionalism. I have developed and honed the following skills in order to achieve the maximum degree of effectiveness.
1. The ability to gain respect and cooperation.
2. The ability to uncover evidence and obtain complete statements from victims, witnesses, defendants, and suspects.
3. The ability to detect and uncover discrepancies
and inconsistencies during the course of an interview.
4. The ability to record accurate, concise, and detailed notes.
5. The ability to connect intervals of time and actions.
6. The ability to develop contacts and sources of information.
7. The ability to accomplish accurate diagrams and photographs.
8. The ability to collect, process, identify, and classify evidence.
9. The ability and discretion to call upon experts in the evaluation of evidence.
10. The ability to accurately and clearly testify in court with credibility.
I use the following components of investigative procedure as a guide and formula when conducting a criminal defense investigation. The procedures can be amended or expanded to suit the individual needs of each case. The procedure is designed by Brandon Perron to apply effectively to all criminal defense cases from simple battery to first degree murder.
1. Investigative review of the discovery file; police reports, victim/witness statements, crime scene examinations, lab reports, etc.
2. Initial Defendant Interview.
3. Crime Scene Examination, Diagram, & Photography.
4. Victim/Witness Background Investigation.
5. Witness Location, Interviews, and Statements.
6. Report of Investigation & Testifying
I will not always be required to pursue all of the procedures outlined within. However, I do fully understand each and am able to effectively accomplish each task if called upon to do so.
